Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Purp mobile application and the website at purp.app (together, the “Service”), provided by UPPR (“we”, “us”, or “our”).
By downloading, installing, or using Purp, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Purp is a chopped and screwed music player. It lets you open local audio, browse selected Audius content, apply slowdown and chop processing, and play the resulting mix. Features may change over time as we improve the app.
2. Eligibility
You must be old enough to use Google Play and enter a binding agreement in your country. If you use Purp on behalf of an organization, you represent that you have authority to bind that organization.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Purp on devices you own or control, solely for personal, non-commercial listening, in accordance with these Terms and applicable store rules (including Google Play).
You may not:
- Copy, modify, reverse engineer, or redistribute the app except as allowed by law
- Bypass technical limits, ads, or security features
- Use Purp to infringe intellectual property or other rights
- Use automated systems to abuse Audius, ads, or our infrastructure
- Misrepresent affiliation with UPPR or Purp
4. Your content and responsibility
4.1 Local files
You are solely responsible for the audio files you open with Purp. You confirm that you have the rights needed to play and process those files on your device. Purp does not grant you any rights to third-party music.
4.2 Processing
Mix processing (slowdown, chops, caching) happens for playback within the app. Purp is a player experience, not a license to redistribute copyrighted material. Do not use the Service to create or share infringing copies.
4.3 Audius
Audius tracks and metadata are provided by Audius and its creators. Your use of Audius features is also subject to Audius terms and policies. We are not responsible for Audius availability, catalog changes, or third-party content.
5. Advertising
The free Android app may display advertisements (including banner and interstitial ads) via Google AdMob. Ads may be personalized based on your consent choices where required by law. Interfering with ad delivery may result in limited or suspended access.
6. Privacy
Our Privacy Policy explains how information is handled when you use the Service. By using Purp, you acknowledge that policy.
7. Intellectual property
Purp, its branding, UI, code, and related materials are owned by UPPR or its licensors. These Terms do not transfer ownership to you. Third-party trademarks (including Audius and Google) remain the property of their owners.
8. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that Purp will be uninterrupted, error-free, or compatible with every device, file format, or Audius endpoint.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPPR AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR PURP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) TEN EUROS (€10).
Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent allowed.
10. Indemnity
You agree to defend and indemnify UPPR against claims arising from your misuse of the Service, your audio content, or your violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.
11. Third-party services
The Service may depend on third parties (Google Play, AdMob, Audius, device OS). Those services have their own terms. We are not responsible for third-party outages, policy changes, or content.
12. Termination
You may stop using Purp at any time by uninstalling it. We may suspend or discontinue the Service, or restrict access, if you violate these Terms, if required by law, or if we discontinue the product. Sections that by nature should survive (including intellectual property, disclaimers, and liability limits) will survive termination.
13. Changes
We may update these Terms. We will revise the “Last updated” date when we do. If a change is material, we may also provide notice in the app or on the website. Continued use after the effective date constitutes acceptance, unless applicable law requires otherwise.
14. Governing law
These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules. Courts of Belgium have jurisdiction, except where mandatory consumer protection laws in your country of residence give you the right to bring claims there.
